Agreement to Terms
These Terms of Service govern your use of Ranksper’s AI Studio, Content Studio platforms, website, and related services. By creating an account or using any of our services, you agree to be bound by these terms.
If you don’t agree with any part of these terms, you cannot use our services. These terms apply to all users, including visitors, registered users, and paying customers.
Account Registration and Management
Creating Your Account
To access our AI platforms, you must create an account with accurate and complete information. You’re responsible for keeping this information current. Provide a valid email address that you regularly check, as this is how we’ll communicate important account information.
Your account is personal and non-transferable. You cannot share your login credentials with others or allow multiple people to use the same account. If you’re a business and need multiple users, we offer team plans with individual accounts for each user.
Account Security
You’re solely responsible for maintaining the security of your account and password. Use a strong, unique password that you don’t use elsewhere. Enable two-factor authentication when available for additional security.
If you discover any unauthorized access to your account, notify us immediately at support@ranksper.com. We’ll help secure your account, but you remain responsible for any activity that occurs under your credentials before you report the breach.
Account Termination
You can delete your account at any time through your account settings or by contacting support. When you delete your account, we’ll remove your personal information within 30 days, but some data may remain in our systems for legal or operational purposes.
We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activities, or pose security risks to our platform or other users. Before termination, we’ll typically provide notice and an opportunity to resolve the issue unless immediate action is required for safety or legal reasons.
Acceptable Use of Our Services
What You Can Do
Ranksper is designed to help you create better marketing content and improve business productivity through AI. You can use our platforms to analyze content performance, automate routine tasks, and generate insights for your business operations.
You may use the content and insights generated by our AI tools in your business operations, marketing materials, and other professional activities. The outputs you create using our tools belong to you.
What You Cannot Do
You cannot use our services for any illegal activities, including but not limited to fraud, money laundering, or violating intellectual property rights. Don’t attempt to reverse engineer, hack, or compromise our systems or other users’ accounts.
Spam, harassment, and abusive behavior toward other users or our staff is prohibited. Don’t upload malicious code, viruses, or content designed to harm our systems or other users’ devices.
You cannot resell, redistribute, or create derivative products from our proprietary AI models, templates, or core platform functionality without explicit written permission.
Content Standards
Any content you upload or share through our platform must be lawful and not infringe on others’ rights. Don’t upload content that contains personal information about others without their consent, copyrighted material you don’t own, or content that promotes violence, discrimination, or illegal activities.
We reserve the right to remove content that violates these standards and may suspend accounts for repeated violations.
Intellectual Property Rights
Our Intellectual Property
Ranksper owns all rights to our platform, including the underlying AI technology, user interface design, proprietary algorithms, and original content. Our trademarks, logos, and branding materials are protected intellectual property.
You’re granted a limited, non-exclusive license to use our platform according to these terms. This license doesn’t include the right to copy, modify, or distribute our core technology or create competing services.
Your Content and Data
You retain ownership of all content you upload to our platform and any original work you create using our tools. By using our services, you grant us a limited license to process your content for the purpose of providing our AI services.
We don’t claim ownership of your business data, marketing content, or other materials you create. This includes content generated with the help of our AI tools – the outputs belong to you.
Content You Share With Us
When you provide feedback, suggestions, or participate in beta testing, you grant us the right to use these contributions to improve our services. We may incorporate your ideas into our platform without compensation, though we’ll always appreciate your input.
If you share content publicly through our platform or community features, you’re responsible for ensuring you have the right to share that content.
Payment Terms and Billing
Subscription Fees and Billing
Our services are provided on a subscription basis with monthly or annual billing cycles. Prices are clearly displayed before you subscribe, and you’ll receive email confirmations of all charges.
Subscriptions automatically renew unless you cancel before your next billing date. We’ll charge your payment method on file, and if payment fails, we’ll attempt to retry billing and notify you of any issues.
Price changes for existing subscriptions require 30 days advance notice. The new pricing will apply at your next billing cycle after the notice period.
Payment Methods and Processing
We accept major credit cards and PayPal for subscription payments. All transactions are processed securely through our payment partners, and we don’t store your complete payment information on our servers.
If your payment method expires or becomes invalid, update your payment information promptly to avoid service interruption. Failed payments may result in account suspension after a brief grace period.
Taxes and Additional Fees
Subscription prices may not include applicable taxes, which will be calculated and added at checkout based on your billing address. You’re responsible for any taxes associated with your use of our services.
We don’t charge setup fees or hidden costs beyond your subscription price and applicable taxes.
Service Availability and Modifications
Platform Availability
We strive to maintain high uptime and service availability, but we cannot guarantee uninterrupted access to our platform. Scheduled maintenance, technical issues, or extraordinary circumstances may temporarily limit service availability.
We’ll provide advance notice of planned maintenance when possible and work to minimize disruption to your business operations.
Service Changes and Updates
We regularly update our platform to add features, improve performance, and address security issues. Most updates enhance functionality without affecting your existing workflows.
Significant changes that might impact how you use our services will be communicated through email or platform notifications. We may occasionally need to make immediate changes for security or legal compliance without advance notice.
Feature Discontinuation
If we decide to discontinue a feature or service, we’ll provide at least 90 days notice when possible. We’ll help you transition to alternative solutions or export your data before any service discontinuation.
Privacy and Data Protection
Your privacy and data security are fundamental to our service. Our Privacy Policy explains in detail how we collect, use, and protect your personal information and business data.
We implement industry-standard security measures to protect your data, including encryption, access controls, and regular security audits. However, no internet-based service can guarantee complete security, and you acknowledge this inherent risk.
You’re responsible for backing up any critical data you store on our platform. While we maintain regular backups for operational purposes, these are not intended as a customer backup service.
Third-Party Integrations and External Links
Our platform may integrate with third-party services to enhance functionality. These integrations are governed by the third party’s terms and privacy policies in addition to ours.
We may include links to external websites or services for your convenience. We don’t control these external resources and aren’t responsible for their content, privacy practices, or terms of service.
Warranties and Disclaimers
Service Disclaimer
Our platform is provided “as is” and “as available” without warranties of any kind, either express or implied. We don’t guarantee that our service will meet your specific requirements, operate without interruption, or be completely error-free.
While we work hard to ensure our AI provides accurate and useful outputs, we cannot warrant the accuracy, completeness, or reliability of AI-generated content or insights. You should always review and verify AI outputs before using them in your business.
No Professional Advice
Our AI tools and platform provide information and insights, but they don’t constitute professional advice. You shouldn’t rely solely on our AI outputs for legal, financial, medical, or other professional decisions without consulting qualified professionals.
Limitation of Liability
To the maximum extent permitted by law, Ranksper and its employees, directors, and partners will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services.
Our total liability for any claims related to our services is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
These limitations apply even if we’ve been advised of the possibility of such damages and regardless of the legal theory underlying your claim.
Indemnification
You agree to defend, indemnify, and hold harmless Ranksper and its affiliates from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any third party’s rights.
This includes reasonable attorneys’ fees and costs associated with defending against such claims.
Dispute Resolution
Governing Law
These terms are governed by the laws of India without regard to conflict of law principles. Any disputes will be resolved in the courts located in Gujarat, India.
Resolution Process
Before filing any legal action, you agree to first attempt to resolve disputes through direct communication with our support team. Many issues can be resolved quickly through discussion.
If direct resolution isn’t possible, both parties agree to attempt mediation through a mutually agreed upon mediator before pursuing litigation.
Changes to These Terms
We may update these Terms of Service to reflect changes in our services, legal requirements, or business practices. When we make material changes, we’ll notify you by email and provide a summary of key changes.
Updated terms take effect 30 days after notification. Continued use of our services after this period constitutes acceptance of the new terms. If you don’t agree with updated terms, you can cancel your account before they take effect.
We maintain an archive of previous terms versions, which you can request by contacting support.
Account Data and Termination
When your account is terminated (by you or us), you have 30 days to download any data you want to keep. After this period, we may delete your account data as described in our Privacy Policy.
Some information may be retained longer for legal, tax, or operational purposes, but this data will not be accessible through your account.
General Provisions
Entire Agreement
These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Ranksper regarding your use of our services.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
Assignment
You cannot assign or transfer your rights under these terms to another party without our written consent. We may assign our rights and obligations to affiliates or in connection with a merger, acquisition, or sale of assets.
Force Majeure
We won’t be liable for any failure to perform our obligations due to causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, or government actions.
